			<content:encoded><![CDATA[<p>China&#8217;s top legislature will discuss the constitutional reform package of Hong Kong, which refers to the amendments to the methods of selecting the city&#8217;s Chief Executive and forming the Legislative Council in 2012, during a bimonthly session scheduled from Aug. 23 to 28.</p>
<p>The draft amendments to Annexes I to the Basic Law of the Hong Kong Special Administrative Region concerning the methods for the selection of the Chief Executive was submitted to the National People&#8217;s Congress (NPC) Standing Committee for approval by Hong Kong Chief Executive Donald Tsang.</p>
<p>The draft amendments to Annexes II concerning the formation of the city&#8217;s Legislative Council was submitted to the NPC Standing Committee for the record.</p>
<p>The Legislative Council of Hong Kong passed the draft amendments in June, before Donald Tsang gave his consent to draft amendments later in the month.</p>
<p>According to Monday&#8217;s Chairmen&#8217;s Council of the NPC Standing Committee, presided over by NPC Standing Committee Chairman Wu Bangguo, lawmakers will also continue to deliberate draft amendments to the law on officers in reserve service, the draft law on mediation, as well as the draft law on the application of laws to civil relationships involving foreign interests.</p>
<p>Lawmakers will also deliberate for the first time draft amendments to the law of deputies to the NPC and local People&#8217;s Congresses, draft amendments to the Criminal Law, the draft law on intangible cultural heritages, and the draft revision of the soil and water conservation law.</p>
<p>Also on the agenda of the upcoming session are discussions of the reports on implementation of the national economic and social development plan and budgets, among others.</p>

<div class="authordate">Respondents to our web poll last week tipped Hong Kong&#8217;s stockmarket to outperform its biggest regional rivals in the second half of 2010.</div>

<p>Pitched against Seoul, Sydney and Tokyo, our readers came out strongly in favour of Hong Kong. Analysts agree that the city&#8217;s main Hang Seng Index will perform well during the coming six months. Citi is forecasting it to rise to 23,300 by year-end, which is a 16% gain from yesterday&#8217;s close.</p>
<p>Forecasts for Australia&#8217;s main index are even more bullish, however. Citi predicts the ASX 200 will reach 5,500 by the end of December, up 26% from yesterday&#8217;s level. The Nikkei and the Kospi are both predicted to post much more modest returns during the rest of the year, with most forecasts suggesting that Tokyo stock prices will continue to fall.</p>
<p>In total, 59% of our voters picked Hong Kong, while 18% followed the analysts&#8217; consensus and went for Australia. Seoul attracted 15% of the vote and an optimistic 8% chose Tokyo.</p></div>

			<content:encoded><![CDATA[<p>Hong Kong&#8217;s financial watchdog said yesterday that it planned to tighten monitoring of the city&#8217;s credit rating agencies to meet new standards set by the European Union and other overseas jurisdictions.</p>
<p>The Securities and Futures Commission (SFC) said it planned to launch the regulatory regime as soon as early next year, including a new licensing regime for agencies and their analysts.</p>
<p>Under the proposal, Hong Kong-based credit rating agencies (CRAs) and their analysts would have to disclose how they assess companies and investment products to obtain a licence.</p>
<p>That licence could be revoked if they did not follow assessment procedures, or were found to have invested in products that they themselves had rated.</p>

<p>&#8220;We consider that it would be in the public interest to establish a regulatory regime to enhance investor protection and to enable credit ratings prepared by Hong Kong-based CRAs to be serviceable in other jurisdictions,&#8221; Julia Leung, the city&#8217;s Undersecretary for Financial Services and the Treasury, told lawmakers.</p>
<p>Starting in June 2011, the European Union will prohibit any credit rating issued by a non-EU agency, unless it operates within a regulatory regime that is equivalent to or as stringent as the EU regime.</p>
<p>Leung said the licensing system must be in place before the EU policy takes effect, adding that the US, Japan and Australia had already announced strengthened regulation of CRAs in recent months.</p>
<p>Stephen Tisdall, senior director of intermediaries licensing and conduct at the SFC, said the proposed regime was more stringent than other jurisdictions, which do not require rating analysts to be licensed. - AFP</p>

<p><span style="8px;">&#8220;Imagine I&#8217;m a gay man. I come to work every week on a Monday morning and, as is normal, my colleagues say &#8216;how did you spend your weekend?&#8217; I say &#8216;I had fun, I was with my friend&#8217;&#8230; [thus] every Monday for six years, I lie about my identity and lie about being gay,&#8221; said Shalini Mahtani, founder of Community Business, a Hong Kong-based non-governmental organisation (NGO) .</span></p>

<p>Mahtani is not a gay man, nor does she lie about her sexual identity on a daily basis, but she is co-author of the organisation&#8217;s latest report, <em>Creating Inclusive Workplaces for LGBT Employees: A resource guide for employers in Hong Kong</em>, which was released yesterday at an event attended by representatives of numerous companies, including Bank of New York Mellon, Citi, IBM and Wells Fargo Bank. Unfortunately though, her poignant example and the guide shed light on a very real fact &#8212; in every workplace in Hong Kong and around Asia, unbeknown to many of us, there are colleagues who live through this very situation every day.</p>
<p>&#8220;Someone who has to conceal their identity on a daily basis, is never going to be as engaged,&#8221; said Mahtani. &#8220;It makes business sense to be inclusive.&#8221;</p>
<p>Community Business worked with co-sponsors Goldman Sachs and IBM to publish the resource guide. Founded in 2003, the NGO&#8217;s original focus was corporate social responsibility work but it has focused on diversity in the workplace issues since 2005. It is well known for the Diversity and Inclusion in Asia Network (Dian) and annual reports on women in the workplace.</p>
<p>The LGBT (lesbian, gay, bisexual, transgender) guide outlines five reasons why businesses in Hong Kong should have accepting work environments: improved productivity and performance; a higher calibre of job applicants; increased employee retention; an improved public image; and a competitive advantage over companies that do not have an openly accepting workplace. Based on these metrics, Mahtani said multinational companies lead the way in Hong Kong. But investment banks really set the example.</p>
<p>&#8220;It really started with the investment banks, as well as the top notch IT companies,&#8221; she said on LGBT inclusive workplaces in Hong Kong and Asia. &#8220;It has progressed to the retail banks and food and beverage companies, and is progressing to the suppliers of particularly the banks, including accounting and legal firms.&#8221;</p>
<p>Goldman Sachs is considered one of the best with regard to LGBT issues in Asia. The institution has a dedicated regional LGBT intranet, sends out a diversity newsletter on a regular basis to its staff and holds numerous forums and events on the subject for employees and senior management throughout the region.</p>
<p>&#8220;At Goldman Sachs in Hong Kong and throughout Asia, we have ensured that our policies treat all employees equally and that where possible our benefits apply the same for opposite and same sex partners,&#8221; said Stephen Golden, head of diversity for the bank in Asia.</p>
<p>Goldman is not alone. Other institutions have or are pursuing their own diversity policies and participate in local groups such as the Hong Kong LGBT interbank group. Interbank members include Bank of America Merrill Lynch, Citi, Credit Suisse, Deutsche Bank, Goldman, J.P. Morgan, Nomura, UBS and Wells Fargo. Representatives of the group marched in Hong Kong&#8217;s second ever gay pride parade last November.</p>
<p>&#8220;I&#8217;m challenging our employees to come up with a diversity policy that fits them,&#8221; said Christopher Sturdy, Asia-Pacific chairman of BNY Mellon. &#8220;As a foreigner, I&#8217;m wary of saying what I think we need.&#8221; He added that as a company, BNY Mellon is &#8220;explicitly diverse&#8221;.</p>
<p>Sturdy&#8217;s challenge to bring the institution&#8217;s LGBT inclusive policies to Asia is not solely out of goodwill, he is also one of the few openly gay bank executives in the region. As such, he has a unique ability to drive workplace acceptance in Hong Kong and throughout the bank&#8217;s Asia-Pacific operations.</p>
<p>&#8220;We have a number of formative diversity groups for Asia-Pacific,&#8221; he said. &#8220;We are testing the waters with these groups and, for example, are promoting the upcoming screening of the film <em>Prayers for Bobby </em>among our employees in Hong Kong.&#8221;</p>
<p>Asked about his experience as an openly gay senior executive in Asia, Sturdy said: &#8220;It has been a positive experience. Our employees are still in the process of figuring out how to deal with it, but it has never been an issue and BNY Mellon is extremely supportive.&#8221;</p>
<p>Yulee Teng, diversity liaison for Asia-Pacific at Citi, said that while the bank does not have an LGBT network in Hong Kong, she plans to use the Community Business resource guide to start one. She said that she will use the Hong Kong diversity committee as a springboard for this and hopes to organise an event for the entire bank with a speaker who can discuss LGBT-related topics. She added that Citi was committed to providing employees with an inclusive working environment.</p>
<p>&#8220;With around 50,000 employees in Asia-Pacific, our diversity is something we are very proud of,&#8221; said Teng. &#8220;Today&#8217;s event underlined our commitment to the LGBT community in Hong Kong.&#8221;</p>
<p>Inviting a speaker to discuss LGBT issues with a company&#8217;s entire workforce is just one of 18 recommendations made by Community Business&#8217;s resource guide to foster more inclusive workplaces. Other suggestions include senior management support, diversity training, anti-discrimination policies and internal activities and groups.</p>
<p>Mahtani said she is hopeful that the guide will encourage Hong Kong&#8217;s businesses to create more inclusive work environments. She added that it was designed as a resource to provide companies with achievable objectives, local best practices and case studies to help them become more accepting workplaces. At the same time, she acknowledged that up until this point, LGBT issues in the workplace have largely not been addressed in Hong Kong.</p>
<p>&#8220;It&#8217;s legal to be gay in Hong Kong in the crudest sense,&#8221; said Mahtani, referring to the fact that sodomy was decriminalised in 1991 and the age of consent equalised in 2006. &#8220;But it&#8217;s not at all equal.&#8221; At least not yet.</p>

<div class="content_text_block">The annual exhibition at the City Hall organised by the Hong Kong Publishing Federation could be regarded as the predecessor of the Hong Kong Book Fair. The First Hong Kong Book Fair was held in 1990 and this year it is its 20th year. The Fair has become an annual major event in Hong Kong with the number of visitors reaching new high every year. The organiser, the HKTDC, has always been striving to promote local reading culture. Apart form extensively inviting the public to the Fair to visit and buy books, it also spares no effort in organising diversified cultural activities during the Book Fair period with a view to enhance the contents and quality of the Fair.</div>
<div class="content_text_block">During the past 20 years the number of exhibitors has grown from 149 to 504 in 2009, with corresponding growth of attendance from 200,000 to 900,000 in 2009. The Fair has developed from a mere promotion platform for the industry to an annual territory-wide major reading and cultural event for the public of Hong Kong.</div>

			<content:encoded><![CDATA[<p><span style="normal;">The cosmetics and skincare brand attracts CIC as a cornerstone investor and is on track to become the first French company to list in Hong Kong.</span></p>
<div class="authordate">L&#8217;Occitane International, the French cosmetics and skincare brand, yesterday kicked off the institutional roadshow for its Hong Kong IPO, which is aiming to raise between HK$4.69 billion and HK$5.49 billion ($605 million to $708 million).</div>

If successful, it will become the first French company to list on the Hong Kong stock exchange, and as such will be a major feather in the cap for the stock exchange marketing team, which has worked hard in recent years to attract companies from outside Greater China to its main board. It will also show that Hong Kong has an allure not just as a potential hub for resources companies that are targeting China as a major market for their goods, but for other types of companies that are looking to expand in Asia as well.</p>
<p>L&#8217;Occitane, which is based in Provence, is already a well-known brand in most of the region and Japan is currently its largest market globally (followed by the US and France), but the company&#8217;s growth strategy involves focusing particularly on the huge, but still emerging, consumer markets in Brazil, Russia, India and China (the Bric countries) as well as in Mexico, where it sees the strongest growth potential. The company started off conservatively in China, where it opened its first store in 2005, but impressively it has been profitable in this market from day one, which is rare for a foreign brand.</p>
<p>This has clearly not gone unnoticed and its IPO has already received a nod of approval from China Investment Corp, China&#8217;s $200 billion sovereign wealth fund, which has agreed to support the IPO as a cornerstone investor. CIC will buy $50 million worth of shares, or 8.3% of the deal if priced at the bottom of the range.</p>
<p>The deal comprises 25% of the company or 364.12 million shares, which are offered at a price between HK$12.88 and HK$15.08. Based on the projected earnings for the fiscal year to March 2011, this translates into a price-to-earnings multiple of 18.7 to 21.9 times.</p>
<p>Sources say this is well below the fair value estimated by some of the syndicate banks, and it also pitches L&#8217;Occitane at a discount to Japanese peers such as Shiseido and Fancl, which currently trade at 2010 P/E multiples of about 30. However, it will look more expensive versus fellow French brand L&#8217;Oreal, which as of yesterday was quoted at 21.2 times this year&#8217;s earnings.</p>
<p>Of the total number of shares, half will be sold by the company and half by parent company L&#8217;Occitane Groupe. As usual in Hong Kong, 10% of the deal will be set aside for retail investors. The final price will be determined on April 30 and the shares are scheduled to start trading on May 7.</p>
<p>Sources have earlier said that they feel L&#8217;Occitane will be a relatively easy sell, especially with retail investors, who are already familiar with the brand, which is known for its natural and organic ingredients and fragrances. Provence, where the company grows the lavender, olive and essential oils that are the major ingredients of its products, is also a popular holiday destination with Asian tourists who are apparently fascinated by the scenery in the region.</p>
<p>Institutional investors may be looking more at the numbers behind the image, but they too seem to spot some potential and one source said orders were coming in at a steady pace after the management&#8217;s lunch presentation in Hong Kong yesterday.</p>
<p>In the three years to March 31, 2009 L&#8217;Occitane&#8217;s net sales grew at a compound annual growth rate of 26.7% and in the last of those three years the sales amounted to €537.3 million ($723 million). In the nine months to December 31, 2009, the company had sales of €462.7 million. On this it earned a net profit of €58.4 million in the year to March 2009 and €66.4 million in the nine months to December last year. It also estimates a net profit of €73.8 million in the fiscal year to March 2010, representing a 26% increase from the previous year. All according to a preliminary listing document posted on the stock exchange web site.</p>
<p>The company&#8217;s products are sold in more than 80 countries through 1,500 retail locations that either sell L&#8217;Occitane products exclusively or are decorated with standardised L&#8217;Occitane design. Of those retail points, 753 are the company&#8217;s own stores, 470 are operated by third party distributors and 294 are operated by airport and duty-free customers. It opened its first store in Hong Kong in 1995.</p>
<p>Its products are also distributed through its own internet shopping websites, mail-order and spas.</p>
<p>Profitability will be a key consideration as the company continues to expand, L&#8217;Occitane said in the listing document. &#8220;Our principal consideration in deciding whether to establish a new store is the store&#8217;s expected contribution to our profits. We intend to open new stores subject to expected rate of investment return, and would not normally establish a new store merely to gain market share.&#8221;</p>
<p>The IPO is being arranged by CLSA, HSBC and UBS.</p></div>

			<content:encoded><![CDATA[<p>Hong Kong plans to tighten rules on marketing of uncompleted apartments, responding to concerns that misleading sales tactics by developers have contributed to a surge in prices this year.</p>
<p>The measures will require developers to provide more transparency about the square footage of apartments they are selling before completing, as well as information on floor numbering, the Transport and Housing Bureau said.</p>
<p>Chief Executive Donald Tsang Yam-kuen said the rules were reached in an agreement with the Real Estate Developers Association of Hong Kong.</p>
<p>Hong Kong said developers will need to spell out the usable square footage inside the homes.</p>
<p>It also will require that developers provide floor numbering information in a more prominent manner in the sales brochures.<br />
Developers will also need to publicly disclose transactions of uncompleted apartments within five working days of signing a preliminary sales agreement, down from the current one month.</p>
<p>The government is deeply concerned about some recent sales tactics in the first-hand uncompleted residential property market and confusing market information, the Transport and Housing Bureau said.</p>
<p>The new measures will further enhance the transparency of transactions of uncompleted first-hand residential properties and the clarity of property information.</p>
